Legal framework of MyKeyZen conciergerie services
1. Object and Scope of Application
These Terms and Conditions (T&C) govern the contractual relationship between MyKeyZen (hereinafter "the Provider") and any physical or legal person (hereinafter "the Client" or "the Owner") wishing to benefit from the conciergerie and seasonal rental management services offered on the Site.
Any order for service implies unreserved acceptance of these T&C, which prevail over any other document, unless specific written agreement between the parties.
2. Nature of Services
MyKeyZen offers comprehensive rental management assistance including:
- Digital Management: Creation and dissemination of optimized listings, pricing, and calendar management.
- Guest Logistics: 7/7 communication, check-ins and check-outs, welcome gifts.
- Premium Maintenance: Professional cleaning after each stay, laundry, property status verification.
3. Financial Terms and Commission
MyKeyZen's remuneration is set at 20% (Net) of the gross amount of rents collected (excluding cleaning fees collected from the traveler). MyKeyZen issues a monthly invoice or deducts its commission directly from the income paid to the Client, depending on the platforms used.
The Client agrees to maintain rates consistent with the market and accepts that MyKeyZen may adjust prices dynamically to optimize the occupancy rate.
4. Mandate and Obligations of the Client
The Client guarantees that they are legally authorized to rent their property. They commit to providing decent housing, compliant with current safety regulations and equipped with a functional internet connection. The Client gives full mandate to MyKeyZen to act on their behalf with third parties and travelers for the smooth running of stays.
5. Duration, Termination, and Current Reservations
The management contract is concluded for an indefinite period without minimal commitment. Either party may terminate it with 30 days' notice. However, the Client is obliged to honor (or entrust the management to MyKeyZen) all reservations confirmed before the effective termination date.
6. Insurance and Liability
MyKeyZen declines all responsibility for minor damage related to normal wear and tear of the property. For any damage caused by a traveler, MyKeyZen will assist the Client in claim procedures with booking platforms (e.g., AirCover Guarantee). The Client must have a Landlord Insurance (PNO).
7. Dispute Resolution
In the event of a dispute, the parties commit to seeking an amicable solution before any legal action. Otherwise, the dispute will be brought before the Commercial Court of Carcassonne.
